2. Why does Am-Investigations collect personal data?

Am-Investigations therefore has a legal mandate to perform certain tasks and powers.

These are described in the Act regulating the profession of private detective 19 July 1991, but think especially

to: Article 1

• locating missing persons or lost or stolen goods

• obtaining information about marital status, behaviour, morality and financial status of persons

• Gathering evidence to establish facts that give rise or may give rise to conflicts between persons, or that can be used to end those conflicts

• detecting corporate espionage

• any other activity determined by a royal decree deliberated in the Council of Ministers

3. Which personal data does Am-Investigations process and why?

    1. The personal data you share with us

​

Am-Investigations records direct contact details of the customers who contact them, including telephone number, mobile number, and email address. We do this in order to provide a better service and to organize the procedure for you as cost-effectively as possible.

    2. The personal data our systems collect.

​

      Am-Investigations registers all financial data (account number, account owner, amount..)

      when you make a payment to our   organization.
 

         3.  The personal data we obtain from third parties.

             Am-Investigations receives from the client all data necessary for the execution of the legal tasks of detective. (Law regulating the                 profession of private detective 19 July 1991) This is mainly identification data (name, address, contact details), as well as underlying data that are necessary                 are  on   to answer your questions.

      Am-Investigations has access as a detective office, and uses publicly accessible sources.

     4. Which personal data do we pass on, to whom and why?

   1. Transfer to the client

Am-Investigations is bound by an obligation to provide information to its client, but the organization strictly adheres to the                proportionality principle. For example, only information related to the assignment of the data subject is fed back.

   2. Transfer to the lawyer/counsel

Data necessarily bound to the procedure will also be passed on to the counsel for the assignment

giving party.  During the hearing, the legal counsel must have the necessary reports and evidence at his disposal.

3. Transfer to government services.

​

In the performance of our duties, data may be requested at the request of government services. This notification obligation consists of the private investigator being required to provide information if the Minister of the Interior, the Minister of Justice or the judicial authorities so request. The detective is obliged to answer this without delay if the request meets certain conditions. Moreover , the government can only use this power in specific cases . As a general principle, it can be stated that the detective is bound by a special duty of confidentiality with regard to information that appears from his investigations. There are, however, some important exceptions to this basic prohibition on passing on information and facts to third parties. In certain cases, all private investigators are subject to a reporting obligation. In addition, there is a separate reporting obligation for the Belgian detective correspondent with regard to shortcomings of the foreign detective who has chosen a fictitious place of business in our country and with regard to persons who process traffic data on behalf of operators in order to detect possible fraud. traces We only deal here with the generally applicable reporting obligation. It can relate to intelligence and crime.'

4. Transfer to other processors

Strict contractual agreements apply to these parties, included in a processing agreement and limited to specific processing. Examples of this are lawyer/counsel, bailiff, court...

5. How long do we keep your personal data?

Am-Investigations may not keep your data for longer than is necessary to achieve the purpose for which it was collected. The written agreement is kept by the private investigator for five years (w1996-12-30/07, art 8.003)

6. What are your privacy rights and how can you exercise them?

     You can address to  privacy@am-investigations.eu to exercise your rights below. When applying, Am-Investigations asks for        to prove the identity of the applicant before Am-Investigations submits the requested information.

1. Your right of access

You have the right to know at any time from Am-Investigations whether or not your personal data is being processed, and if so, to view that data and receive additional information about:
 

• The processing purposes

• The categories of personal data concerned

• The recipients or categories of recipients

• The retention period or the criteria for determining the period

• The existence of your rights

• The right to lodge a complaint with the supervisory authority

• The source of the data

• The existence of automated decision-making

2. Your right to rectification of personal data

You have the right to have incomplete, incorrect, inappropriate or outdated personal data rectified without delay. In any case, in order to keep your data up-to-date, Am-Investigations requests that you report any changes.

3. Your right to erasure (the 'right to be forgotten')

You have the right to have your personal data deleted in the following cases, and without undue delay
 

• Your personal data is unlawfully processed

• Your personal data must be erased to comply with a legal obligation

• Your personal data are no longer necessary for the purposes for which they were collected or processed

• You withdraw your previous consent to the processing and there is no other legal basis for the (further) processing

4. Your right to restriction of processing

You have the right to obtain restrictions on the processing of your personal data if, for example, one of the following applies:

• You contest the accuracy of those personal data: their use is restricted for the period that allows Am-Investigations to verify the accuracy of the data

• The processing of your personal data is unlawful: instead of deleting your data, you request that its use be restricted

5. Your right to portability of personal data.

You have the right to transfer your personal data. This is only possible for the personal data that you provide to Am-Investigations yourself, based on permission or after agreement. In all other cases, you cannot enjoy this right.

6. Your right to object to the processing of your personal data.

​

You have the right to object to the processing of your personal data on the basis of a special situation if the processing is in the context of the legitimate interest of Am-Investigations or in the context of the public interest. Am-Investigations will stop processing this personal data unless Am-Investigations can demonstrate compelling and legitimate grounds for the processing that outweigh yours or if the processing of the personal data is related to the establishment, exercise or defense of legal claims. .
